Terms of Service

1. Service Scope

Vixel provides software tools for developing stories, characters, storyboards, images, video, and edited sequences for AI short films. Vixel also offers interactive storytelling and experimental world experiences. Available features, generation options, and usage limits depend on the product and plan you use.

2. Eligibility and Accounts

You must be at least 18 years old, or the age of majority where you live if that is higher, and legally able to enter into these Terms to create an account, buy a plan or credits, or use Vixel's creation tools.

Vixel is built for adults, including parents, teachers, and studios who make stories for families and children. Children may contribute ideas and drawings only under the supervision of the adult account holder, who is responsible for what is uploaded, generated, and shared.

You are responsible for keeping your account secure and for all activity under it. You can delete your account at any time in the iOS app (Settings › Delete account) or by emailing support@vixelai.com; the Privacy Policy explains what happens to your data.

3. Community Rules: Zero Tolerance

Vixel has zero tolerance for objectionable content and abusive users. You may not use Vixel to create, upload, share, or request:

• any sexual content involving minors, or content that sexualizes, exploits, or endangers minors;
• sexually explicit content or nudity in anything shared publicly;
• intimate or sexual images of a real person without their consent;
• photos, video, or voice recordings of a real child, or a child's name, school, location, or other identifying details;
• the face, voice, or likeness of a real person without their permission, including deceptive "deepfakes" or impersonation;
• harassment, bullying, threats, or hate directed at people or groups;
• graphic violence, or content that promotes self-harm, terrorism, or dangerous acts;
• content that infringes intellectual property, privacy, or publicity rights;
• spam, scams, or misleading content;
• anything unlawful.

You also may not probe, disrupt, reverse engineer, overload, or interfere with the Service or other users; abuse rate limits, payment systems, or access controls; or try to get around our safety measures.

4. Reporting, Blocking, and Enforcement

You can report any video in the iOS app's Feed and block any creator. Blocking hides that creator's videos from you; blocking from a video also reports that video to us. You can also report content by emailing support@vixelai.com.

We review Films before they appear in the Feed, but we cannot review everything in advance. We review reports within 24 hours. When content breaks these Terms, we remove it and may suspend or permanently terminate the account that posted it, without notice or refund.

We remove intimate images of a person shared without their consent within 48 hours of a valid request. We report apparent child sexual abuse material to the National Center for Missing & Exploited Children.

5. Copyright Complaints

If you believe content on Vixel infringes your copyright, send a notice to our copyright agent at support@vixelai.com with the subject "Copyright notice". Include your contact details, the work you believe is infringed, the URL of the material, a statement that you have a good-faith belief the use is not authorized, a statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner, and your physical or electronic signature.

We may remove the material and notify the user who posted it, and we terminate the accounts of repeat infringers in appropriate circumstances.

6. Your Content and Outputs

You retain rights in the prompts, materials, and other content you submit to Vixel, to the extent permitted by law. Only submit material you have the right to use, including permission from anyone who appears in it.

You give Vixel a worldwide, non-exclusive, royalty-free licence to host, store, process, and transmit your content, including to the AI providers named in our Privacy Policy, as needed to operate the Service for you, and to improve and develop Vixel's features and models. For Films you choose to share publicly, this licence also lets us display them publicly, including in the Feed, until you withdraw them or delete your account.

Subject to these Terms and any plan restrictions, you may use outputs generated through the Service for your internal or commercial use. You are responsible for reviewing outputs before using, publishing, or relying on them. AI-generated outputs may be inaccurate, incomplete, offensive, or legally sensitive.

7. Product Changes

Vixel is an evolving software product. We may add, modify, limit, or remove features at any time, including experimental workflows, runtime behavior, pricing, usage limits, or integrations.

8. Billing and Paid Plans

Some features require payment. If you buy a plan or credits, you authorize us and our payment providers to charge the applicable fees, taxes, and recurring subscription amounts. Purchases you start in our iOS app are completed with Stripe on our website; Apple is not a party to them.

Subscriptions renew automatically until you cancel them in Manage billing. Deleting your account stops renewal; unused credits are lost. Unless otherwise stated, fees are non-refundable except where required by law or explicitly provided in writing.

9. Intellectual Property

The Vixel service, product design, software, branding, and related materials are owned by Vixel or its licensors and are protected by applicable intellectual property laws. These Terms do not transfer ownership of the Service itself.

10. Third-Party Services

Vixel relies on third-party services such as hosting, analytics, authentication, email, payment, and AI model providers. Your use of certain features may also be subject to those providers' terms.

11. Disclaimers

Vixel is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, output accuracy, fitness for a particular purpose, or that the Service will be error-free, secure, or suitable for production-critical use.

12. Limitation of Liability

To the maximum extent permitted by law, Vixel and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from or related to your use of the Service.

13. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access at any time if necessary to protect the Service or its users, comply with law, prevent abuse, or enforce these Terms, including the Community Rules.

14. Apps from the Apple App Store

If you downloaded our app from the Apple App Store:

• These Terms are between you and Vixel, not Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. Apple has no other warranty obligation for the app.
• Vixel, not Apple, is responsible for any claims relating to the app, including product liability, failure to meet legal or regulatory requirements, consumer protection, and intellectual property infringement claims.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any third-party terms that apply when you use the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Governing Law

These Terms are governed by the laws applicable in the jurisdiction of the operator, without regard to conflict of laws principles.

16. Updates

We may revise these Terms from time to time. Updated Terms become effective when posted on this page unless otherwise stated. For material changes, we will also tell you in the app or by email.
